Kajuby Plugin License Terms

These License Terms apply to VST3 plugins and standalone instruments developed and released under the name Kajuby by Rouven Dahlen.
By downloading, installing, copying, or using a Kajuby plugin, you agree to these License Terms.
1. License Grant
Kajuby grants you a non-exclusive, worldwide, perpetual license to use the applicable plugin for musical and creative production purposes.
The license is free of charge. Some products may optionally be offered through a Pay What You Want model via Gumroad. A voluntary payment does not grant additional rights beyond those described in these License Terms.
You may install and use the plugin on an unlimited number of computers that you own or control.
You may use the plugin for both personal and commercial purposes.
2. Commercial Use
You may use Kajuby plugins to create music and other audio content for commercial or non-commercial purposes.
This includes, without limitation:
- music releases;
- streaming releases;
- YouTube content;
- films and video productions;
- games;
- advertising;
- commissioned productions;
- soundtracks;
- commercial recordings;
- synchronization projects.
Audio rendered or produced using a Kajuby plugin may be freely distributed, published, licensed, sold, or otherwise commercially exploited.
No additional royalty or attribution is required for music or other audio created using the plugin.
3. Redistribution of the Plugin
You may redistribute the original Kajuby plugin files, including through:
- personal websites;
- download platforms;
- file-sharing services;
- torrent networks;
- community forums;
- other distribution channels.
However, redistribution is permitted only if you clearly identify Kajuby as the source of the plugin.
The attribution must identify the plugin as a Kajuby product and, where reasonably possible, provide a link to: https://www.kajuby.de
You may not falsely claim authorship of the plugin or remove copyright notices or other attribution information contained in the original files.
4. Redistribution in Collections and Bundles
You may include Kajuby plugins in a larger collection or software bundle only where the complete collection or bundle is provided free of charge.
Kajuby plugins may not be included in a paid software bundle, paid sample pack, paid preset pack, or other commercial package without prior written permission from Kajuby.
5. Prohibited Uses
You may not:
- sell the Kajuby plugin itself as a standalone product;
- sublicense the plugin;
- claim authorship of the plugin;
- remove or intentionally obscure Kajuby copyright or attribution notices;
- incorporate the plugin into another commercial software product;
- use the plugin as a component of a commercial plugin collection without prior written permission;
- redistribute modified versions of the plugin as if they were official Kajuby releases.
The fact that redistribution is permitted under Section 3 does not grant any ownership of the underlying intellectual property.
6. Reverse Engineering
Reverse engineering, decompilation, disassembly, modification, or attempts to derive the source code of a Kajuby plugin are not permitted except:
- where expressly permitted by applicable law; or
- where Kajuby has given prior written permission.
Nothing in these License Terms is intended to restrict mandatory rights that cannot legally be excluded under applicable law.
7. Source Code Requests
Kajuby may, at its sole discretion, provide source code or portions of source code to individuals upon request for specific purposes.
A source code request does not automatically grant any right to receive source code.
If source code is voluntarily provided, the recipient may not publish or redistribute it except with prior permission from Kajuby.
Any permitted publication or redistribution of source code must clearly identify Kajuby and the origin of the relevant code.
Third parties may not use Kajuby source code to create or distribute derivative software without the necessary permission from Kajuby, except where such use is permitted by applicable law.
8. Attribution
Where these License Terms require attribution, the following attribution is sufficient:
“Kajuby – [Plugin Name] – https://www.kajuby.de”
You may use an equivalent attribution that clearly identifies Kajuby as the source.
9. Updates
Kajuby may release updates, bug fixes, improvements, new versions, or compatibility updates at its sole discretion.
There is no guarantee that any particular plugin will receive future updates.
There is no guarantee that a plugin will remain compatible with:
- future operating systems;
- future versions of digital audio workstations;
- future versions of VST or other plugin standards;
- future hardware;
- future software environments.
Kajuby may discontinue development or support for any plugin at any time.
10. Removal of Products
Kajuby may stop distributing or offering any plugin at any time.
Removal of a plugin from the Kajuby website, Gumroad, or another distribution platform does not automatically terminate licenses that were already granted under these License Terms.
A previously granted license therefore remains valid unless terminated in accordance with these License Terms or applicable law.
11. Software Provided “As Is”
Kajuby plugins are provided “AS IS” and “AS AVAILABLE”.
To the maximum extent permitted by applicable law, Kajuby makes no guarantee that a plugin will:
- be completely free of bugs or errors;
- work on every computer;
- work with every DAW;
- work with every operating system;
- meet every user's individual requirements;
- remain available indefinitely;
- receive future updates.
The use of the software is at the user's own risk.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Kajuby shall not be liable for indirect, incidental, consequential, special, or unforeseeable damages arising from or relating to the use or inability to use a Kajuby plugin.
This includes, to the extent legally permissible, loss of profits, loss of data, loss of business opportunities, production interruptions, or other consequential losses.
Nothing in these License Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, liability for intent, gross negligence, injury to life, body or health, and any other liability that cannot legally be excluded or limited remains unaffected.
13. Intellectual Property
The plugin itself, including its source code, object code, software architecture, interface, branding, documentation, and associated materials, remains the intellectual property of Kajuby and/or its respective rights holders.
These License Terms grant a license to use the software. They do not transfer ownership of the software or its intellectual property.
14. No Trademark License
The name Kajuby, associated logos, product names, and branding remain the property of their respective rights holders.
Permission to redistribute a Kajuby plugin does not constitute permission to use Kajuby branding in a manner that suggests official endorsement, partnership, sponsorship, or affiliation.
15. Third-Party Rights
If a particular Kajuby product contains third-party components subject to separate license terms, those separate terms may apply to the relevant component.
Kajuby will identify such additional licensing requirements where applicable.
16. Termination
The license granted under these Terms remains effective unless terminated.
If you materially violate these License Terms, Kajuby may terminate your license where permitted by applicable law.
Upon termination, you must stop using the affected plugin and delete copies that you are no longer entitled to retain, except where retention is required or permitted by law.
17. Changes to These License Terms
Kajuby may update these License Terms for future releases or future license grants.
The License Terms applicable to a plugin at the time the license is granted will continue to apply to that previously granted license unless a change is required by law or otherwise expressly agreed with the licensee.
18. Governing Law
These License Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer protection provisions that may apply in the user's country of residence.
Where legally permissible, the place of jurisdiction shall be determined in accordance with the applicable statutory provisions.
